Terms of Service for HexTurf

These Terms of Service govern your access to and use of HexTurf.
By creating an account or using HexTurf, you agree to these Terms and confirm that you have read our Privacy Policy. If you do not agree to these Terms, you must not use HexTurf.
1. About HexTurf
HexTurf is a location based mobile game where players move in the real world, capture hexagonal zones, earn points, join teams, compete for territory and earn or use in game tokens.
The game may include features such as real time map activity, team based gameplay, leaderboards, cooldowns, rewarded video ads, events, tokens and other game mechanics.
HexTurf may change over time. We may add, remove, modify or rebalance features, game rules, scoring systems, tokens, rewards, cooldowns, teams, zones or other parts of the game.
2. Who May Use HexTurf
You may use HexTurf only if you are legally allowed to do so in your country or region.
HexTurf is not intended for children under the age of 13 without parental or guardian approval. If you are under the age of legal majority in your country or region, you may use HexTurf only with permission from a parent or legal guardian.
By using HexTurf, you confirm that:
You are allowed to use the service under applicable law.
You have permission from a parent or guardian if required.
The information you provide is accurate.
You will use HexTurf in a safe and lawful manner.
We may restrict access to HexTurf in certain countries, regions or locations if required by law, safety concerns, technical limitations or platform requirements.
3. Your Account
To use certain features of HexTurf, you may need to create an account.
You are responsible for:
Keeping your login details secure.
Making sure your account information is accurate.
All activity that occurs through your account.
Not sharing, selling, transferring or lending your account to others.
Not using another person's account without permission.
If you believe that your account has been accessed without permission, you should contact us as soon as possible.
We may suspend, restrict or terminate your account if we believe that you have violated these Terms, harmed the game, attempted to cheat, misused the service or created a risk for other users or HexTurf.
4. Location Based Gameplay and Safety
HexTurf is played in the real world. You are responsible for your own safety and for how you move through physical locations while using the game.
You agree that you will not:
Use HexTurf while driving or operating a vehicle.
Enter private property without permission.
Enter restricted, dangerous or unsafe areas.
Ignore traffic rules, signs, barriers or local laws.
Harass, follow, threaten or endanger other people.
Use the game in a way that creates risk for yourself or others.
HexTurf does not give you permission to access any physical location. You are always responsible for following applicable laws, rules and safety instructions in the real world.
You should remain aware of your surroundings at all times while using HexTurf.
5. Game Rules
HexTurf includes game rules that may determine how zones are captured, how long a player must remain in a zone, how points are awarded, how cooldowns work, how tokens are earned or used and how team based competition is calculated.
You agree to follow the rules shown in the app and any additional instructions provided by HexTurf.
We may change game rules at any time in order to improve gameplay, fix problems, prevent abuse, balance the game or introduce new features.
We may correct errors, reverse invalid captures, remove points, adjust tokens, reset zones, modify leaderboards or take other actions if we believe that an error, exploit, cheat, technical issue or misuse has affected the game.
6. Teams, Zones and Leaderboards
HexTurf may allow you to join a team or faction and compete for control of zones.
The game may display information such as team ownership of zones, scores, rankings, captures, activity and other gameplay data.
Leaderboards and scores are part of the game experience. They may change as the game evolves or if we detect errors, cheating, abuse or technical issues.
We do not guarantee that any score, ranking, zone ownership, token balance, reward or game state will remain unchanged.
7. Tokens and Virtual Items
HexTurf may include in game tokens, virtual items, boosts, rewards or similar features.
Unless clearly stated otherwise, tokens and virtual items:
Have no real world monetary value.
Cannot be exchanged for cash.
Cannot be sold, traded or transferred outside HexTurf.
Are licensed to you for use within the game only.
May be changed, limited, removed or reset if needed for balancing, security or technical reasons.
You do not own tokens or virtual items in the same way that you own physical property. You receive a limited right to use them inside HexTurf according to these Terms and the game rules.
We may modify token mechanics, prices, rewards, earning rates, cooldown effects, limits, availability or other token related features at any time.
8. Rewarded Video Ads
HexTurf may allow you to watch rewarded video ads in exchange for tokens or other in game rewards.
Rewarded video ads are optional. Availability may depend on your region, consent settings, device, age, advertising partners, technical conditions and ad inventory.
You may receive a reward only if the ad is successfully completed and confirmed by the advertising provider or HexTurf systems.
We may refuse, delay, reverse or remove a reward if we believe that an ad was not completed, was manipulated, was generated through automated activity or was affected by fraud, abuse or technical error.
Personalized ads and certain advertising features may require your consent. You can manage consent choices in the app settings where available.
9. Purchases and Payments
HexTurf may offer paid features, in game purchases, subscriptions or other paid content in the future.
If purchases are introduced, they may be handled by app stores, payment providers or other third party services. Their own terms and payment rules may apply.
Unless required by law or platform rules, purchases of digital content may be final and non refundable once delivered.
We may change prices, product offerings, subscriptions, token packages or paid features at any time.
10. Fair Play and Anti Cheat
You agree not to cheat, manipulate or abuse HexTurf.
You must not:
Spoof or fake your location.
Use GPS manipulation tools.
Use bots, scripts, emulators or automation to play the game.
Exploit bugs, glitches or technical weaknesses.
Interfere with servers, APIs, traffic or game systems.
Reverse engineer, scrape, overload or attack the service.
Create multiple accounts to gain unfair advantage.
Sell, buy or transfer accounts, tokens or rewards outside HexTurf.
Use the game to harass, threaten, track or target other people.
We may use technical and manual methods to detect cheating, fraud, abuse and abnormal activity.
If we detect or suspect cheating or misuse, we may suspend your account, remove points, remove tokens, reverse captures, restrict features, reset progress or permanently ban your account.
11. User Conduct
You agree to use HexTurf respectfully and lawfully.
You must not:
Upload, share or use offensive, hateful, threatening or illegal content.
Impersonate another person or organization.
Use names, images or content that infringe the rights of others.
Harass, bully, stalk or intimidate other users.
Use HexTurf to organize unsafe, illegal or harmful activities.
Interfere with other users' ability to enjoy the game.
We may moderate, remove or restrict usernames, profile images, content or behavior that we believe violates these Terms or harms the HexTurf community.
12. User Content
HexTurf may allow you to submit usernames, profile images, messages, reports, feedback or other content.
You are responsible for the content you submit.
By submitting content to HexTurf, you grant us a worldwide, non exclusive, royalty free license to host, store, display, reproduce, modify and use that content as needed to operate, improve, promote and protect HexTurf.
You must only submit content that you have the right to use.
We may remove or restrict user content at any time if we believe it violates these Terms, the law, platform rules or the rights of others.
13. Privacy
Your use of HexTurf is also governed by our Privacy Policy.
The Privacy Policy explains how we process personal data, including account data, game data, location data, technical data, analytics data, advertising data, consent choices and support data.
By using HexTurf, you confirm that you have read the Privacy Policy.
Certain features, such as analytics, personalized ads, rewarded video ads and feature update emails, may require separate consent where required by law.
14. Third Party Services
HexTurf may use or integrate with third party services, such as app stores, maps, hosting providers, analytics providers, advertising partners, payment providers, crash reporting tools, authentication providers and anti cheat or security services.
Third party services may have their own terms, privacy policies and technical requirements.
We are not responsible for third party services that we do not control, but we aim to use reputable providers and to provide relevant information where required.
15. App Stores and Platform Rules
If you download HexTurf from Apple App Store, Google Play or another app marketplace, the platform's own terms and rules may also apply.
You agree to follow all applicable platform rules.
The app store provider is not responsible for HexTurf unless required by its own terms or applicable law.
16. Intellectual Property
HexTurf, including the game concept, software, design, graphics, interface, text, logos, names, maps, game mechanics, code, systems, databases and other content, is owned by HexTurf or its licensors.
You receive a limited, personal, non exclusive, non transferable and revocable right to use HexTurf for personal entertainment purposes according to these Terms.
You must not copy, modify, distribute, sell, rent, reverse engineer, decompile, scrape or create derivative works based on HexTurf unless allowed by law or approved by us in writing.
17. Feedback
If you send us ideas, suggestions, bug reports or other feedback, you allow us to use that feedback without restriction or compensation.
We appreciate feedback, but we are not required to treat feedback as confidential or to pay you for using it.
18. Availability and Changes
We aim to keep HexTurf available and working, but we do not guarantee that the service will always be available, uninterrupted, secure or error free.
HexTurf may be unavailable due to maintenance, updates, technical issues, security incidents, third party failures, network problems or other reasons.
We may change, suspend or discontinue parts of HexTurf at any time.
19. Account Suspension and Termination
We may suspend, restrict or terminate your account if:
You violate these Terms.
You cheat, exploit or manipulate the game.
You create safety, security or legal risks.
You misuse tokens, rewards, ads or payment systems.
You harass or harm other users.
We are required to do so by law, platform rules or authorities.
Your account has been inactive for a long period, if we have given notice where required.
You may stop using HexTurf at any time. You may also request deletion of your account according to the Privacy Policy and the tools available in the app.
Account termination may result in loss of access to your account, progress, points, rankings, tokens, rewards and virtual items.
20. Disclaimers
HexTurf is provided on an "as is" and "as available" basis.
To the maximum extent allowed by law, we do not guarantee that:
HexTurf will always be available.
HexTurf will be free from errors or interruptions.
Game data, rankings, zones or rewards will always be accurate.
The app will work on every device or operating system.
The service will meet your expectations.
Any specific reward, token, ranking or result will be available.
Nothing in these Terms excludes or limits rights that cannot be excluded or limited under applicable consumer law.
21. Limitation of Liability
To the maximum extent allowed by law, HexTurf is not liable for indirect losses, lost profits, lost data, loss of goodwill, lost opportunities, personal injury caused by unsafe use of the game, loss of tokens, loss of rankings, interruption of service or other damages arising from your use of HexTurf.
You are responsible for using HexTurf safely and lawfully in the real world.
Our total liability for claims related to HexTurf is limited to the amount you paid to HexTurf during the twelve months before the claim, or EUR 100, whichever is higher, unless applicable law requires otherwise.
22. Indemnity
If you violate these Terms or misuse HexTurf, you agree to compensate HexTurf for reasonable losses, costs, claims or expenses caused by your actions, to the extent allowed by law.
This may include claims related to cheating, unlawful conduct, misuse of the service, infringement of third party rights or unsafe real world behavior.
23. Changes to These Terms
We may update these Terms from time to time.
If we make significant changes, we will provide notice in the app, by email or through another reasonable method.
If you continue to use HexTurf after updated Terms take effect, you agree to the updated Terms.
If you do not agree to the updated Terms, you must stop using HexTurf.
24. Governing Law
These Terms are governed by the laws of Sweden, unless mandatory consumer protection laws in your country or region provide otherwise.
Any dispute should first be handled by contacting us so that we can try to resolve it.
If a dispute cannot be resolved, it may be handled by the competent courts or dispute resolution bodies available under applicable law.
